Definitions

  1. Studio Amami: An online platform that is selling vintage (design) furniture and pre-loved accessories, Chamber of Commerce nr. 72354011.
  2. Customer: People who buy products via the online platform of Studio Amami.

Applicability

  1. The terms and conditions set forth by Studio Amami are applicable to all transactions and interactions with the company. This includes, but is not limited to, all dealings related to the sale and purchase of products, services, and agreements made with Studio Amami.
  2. These conditions are the definitive terms of engagement between Studio Amami and its clients, and any variation from these terms must be mutually agreed upon in a formal, written format.
  3. The influence of external or additional terms from customers or other entities is not recognized under these conditions.

Intellectual Property

  1. All content on the Studio Amami website, including but not limited to text, graphics, logos, images, and photographs, is the property of Studio Amami or its content suppliers and is protected by international intellectual property laws. The compilation of all content on this site is the exclusive property of Studio Amami.
  2. Unauthorized use, reproduction, modification, distribution, or storage of any content on the Studio Amami website for purposes other than personal, non-commercial viewing is strictly prohibited without prior written permission from Studio Amami. This includes any form of copying or adapting the website's HTML code, layout, or any other aspect of the site.
  3. Studio Amami respects the intellectual property of others and asks the same of its users. Any infringement of intellectual property rights will be addressed promptly upon notification.

General

  1. Studio Amami's items are pre-loved and come with signs of aging and general wear, yet they are curated to be fully functional and visually appealing. Customers should consider this when making a purchase and are encouraged to request additional details or images before buying.
  2. While Studio Amami ensures the quality of its items, it does not manufacture them and cannot guarantee their performance or safety, especially for commercial use.
  3. Studio Amami is not responsible for the manner in which customers use the products purchased from our store. Our products are sold for their intended purpose. Studio Amami disclaims all liability for any damage or injury resulting from the improper use, modification, or misuse of the products.
  4. Customers are encouraged to use all products safely and responsibly, and in accordance with any provided instructions or guidelines. It is the customer's responsibility to ensure that any product is suitable for their intended use and to exercise due caution and discretion while using the product. Any queries regarding the safe and appropriate use of our products should be directed to Studio Amami prior to use.

Prices

  1. Studio Amami sets its product and service pricing in euros. This pricing includes VAT but does not cover additional expenses like administration fees, import taxes, and costs related to travel, delivery, or shipping unless specifically stated or agreed upon.
  2. Studio Amami reserves the right to modify its prices at any time as displayed in its store, on its website, or through other channels.

Payment

  1. Studio Amami accepts payments through Shopify for online purchases. In the case of in-person pickups, payment can be made at the location.
  2. The policy of Studio Amami mandates that orders must be fully paid before shipping, unless a different arrangement has been previously agreed upon between Studio Amami and the customer. This ensures a clear and secure transaction process for all parties involved.

Delivery

  1. Studio Amami primarily delivers accessories via PostNL within The Netherlands and DPD for international destinations. Furniture is generally available for pickup only, with delivery options upon special request via email.
  2. Customers are responsible for ensuring they can receive the package at the provided address.
  3. Studio Amami is not liable for any additional costs such as import taxes or other transfer-related expenses beyond initial delivery fees.
  4. In case of damaged items, customers should email Studio Amami within 48 hours, attaching photos of the damage and keeping all original packaging. The decision regarding refunds will be communicated after inspection of the returned item.

Return Policy

  1. Returns are accepted within 14 days of receipt, with the buyer responsible for covering additional return shipping costs.
  2. Within 14 days after receiving the returned package, Studio Amami will refund the customer's money using the original payment method.
  3. A refund only takes place if the returned items are in the same condition as received. Please remember it can take some time for your bank or credit card company to process and post the refund
  4. Items sent back to us without first requesting a return will not be accepted.

Force Majeure

  1. Under circumstances beyond Studio Amami's control, where fulfilling obligations to customers becomes unfeasible or unreasonable, such as in events typically recognized as force majeure, Studio Amami is not held accountable. This includes, but isn’t limited to, severe natural events, technical failures, strikes, government actions, or other serious disruptions.
  2. If such events prevent Studio Amami from meeting its obligations for over 30 days, either party may terminate the agreement in part or in full.
  3. In these force majeure situations, Studio Amami is not liable for any damages or compensation, even if it gains any benefits during this period.

Modification of the Agreement

Should it become necessary to modify or augment the content of the agreement after its establishment but prior to its execution, both parties shall promptly and through mutual discussions make the necessary adjustments to the agreement.

Changes to the General Terms and Conditions

  1. Studio Amami reserves the right to modify or supplement these general terms and conditions.
  2. Minor changes may be implemented at any time without prior notice.
  3. Significant alterations will be communicated and discussed with the customer wherever feasible.
  4. In the case of major changes, consumers have the right to terminate the agreement.

Assignment of Rights

  1. Rights arising from an agreement with Studio Amami may not be transferred to third parties by the customer without Studio Amami's explicit written approval.
  2. Should any clause be found null or voidable, it shall be replaced with a clause that best aligns with Studio Amami's original intent on the matter.

Governing Law and Jurisdiction

  1. All agreements between Studio Amami and the customer are governed exclusively by Dutch law.
  2. Any disputes arising from these agreements will be adjudicated exclusively by the Dutch courts in the region where Studio Amami is located, unless mandated differently by law.
